Building owners, property managers, and boards must stay up to date on new rules and penalties as they plan their inspections and repair programs. Here are the latest updates for 2025:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong data-start=\"150\" data-end=\"183\">FISP Cycle 10 Filing Windows:<\/strong><\/p>\n<ul data-start=\"185\" data-end=\"589\">\n<li data-start=\"185\" data-end=\"304\">\n<p data-start=\"187\" data-end=\"243\"><strong data-start=\"187\" data-end=\"205\">Sub-cycle 10A:<\/strong> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Buildings with block numbers ending in <strong data-start=\"39\" data-end=\"56\" data-is-last-node=\"\">4, 5, 6, or 9<\/strong><\/span><\/p>\n<ul data-start=\"246\" data-end=\"304\">\n<li data-start=\"246\" data-end=\"304\">\n<p data-start=\"248\" data-end=\"304\"><strong data-start=\"248\" data-end=\"266\">Filing Period:<\/strong> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">February 21, 2025 \u2013 February 21, 2027<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"305\" data-end=\"426\">\n<p data-start=\"307\" data-end=\"363\"><strong data-start=\"307\" data-end=\"325\">Sub-cycle 10B:<\/strong> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Buildings with block numbers ending in <strong data-start=\"39\" data-end=\"53\" data-is-last-node=\"\">0, 7, or 8<\/strong><\/span><\/p>\n<ul data-start=\"366\" data-end=\"426\">\n<li data-start=\"366\" data-end=\"426\">\n<p data-start=\"368\" data-end=\"426\"><strong data-start=\"368\" data-end=\"386\">Filing Period:<\/strong> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">February 21, 2026 \u2013 February 21, 2028<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"427\" data-end=\"589\">\n<p data-start=\"429\" data-end=\"487\"><strong data-start=\"429\" data-end=\"447\">Sub-cycle 10C:<\/strong> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Buildings with block numbers ending in <strong data-start=\"39\" data-end=\"53\" data-is-last-node=\"\">1, 2, or 3<\/strong><\/span><\/p>\n<ul data-start=\"490\" data-end=\"589\">\n<li data-start=\"490\" data-end=\"589\">\n<p data-start=\"492\" data-end=\"589\"><strong data-start=\"492\" data-end=\"510\">Filing Period:<\/strong> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">February 21, 2027 \u2013 February 21, 2029<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Access Agreements: Don\u2019t Delay the Process<\/strong><\/p>\n<p>Access agreements are often a hidden hurdle in facade inspection and repair programs. Coordinating access to adjacent properties may involve:<\/p>\n<ul>\n<li>Property Managers<\/li>\n<li>Attorneys<\/li>\n<li>Consultants<\/li>\n<li>Contractors<\/li>\n<\/ul>\n<p>These agreements can take the form of informal arrangements, formal legal agreements, or even court orders if needed. Start early to avoid delays in inspections, probes, or scaffolding work.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>9th Cycle Late Filing Pathway for NRFs<\/strong><\/p>\n<p style=\"text-align: justify;\">Buildings that missed their 9th Cycle FISP filing still have an opportunity to resolve No Report Filed (NRF) violations, regardless of their assigned sub-cycle. If your building was marked as \u201cNRF\u201d for Cycle 9, you may submit a Sub-cycle Override Request and file immediately without waiting for your Cycle 10 filing window.<\/p>\n<p style=\"text-align: justify;\">Keep in mind: If your building has cavity wall construction, the DOB now requires investigative probes as part of the late submission process.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>DOB Filing Fees<\/strong><\/p>\n<p>As of 2025, the following DOB filing fees apply:<\/p>\n<ul>\n<li><strong>Initial Report:<\/strong> $425<\/li>\n<li><strong>Amended or Subsequent Report:<\/strong> $425<\/li>\n<li><strong>Extension Request:<\/strong> $305<\/li>\n<\/ul>\n<p>These costs should be factored into your building\u2019s facade compliance planning.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Updated Civil Penalties<\/strong><\/p>\n<p>Noncompliance comes with steep financial consequences:<\/p>\n<ul>\n<li><strong>Late Filing<\/strong>: $1,000 per month<\/li>\n<li><strong>Failure to File:<\/strong> $5,000 per year<\/li>\n<li><strong>Failure to Correct Unsafe Conditions:<\/strong> Penalties vary case-by-case<\/li>\n<li><strong>Failure to Correct SWARMP Conditions:<\/strong> $2,000<\/li>\n<\/ul>\n<p>Civil penalties are now publicly visible in DOB NOW, increasing both accountability and urgency.<\/p>\n<p>&nbsp;<\/p>\n<p><strong data-start=\"499\" data-end=\"554\">Reminder: New Annual Parapet Inspection Requirement<\/strong><\/p>\n<p>Beginning in 2024, <a href=\"https:\/\/randpc.com\/articles\/surveys-and-inspection\/parapet-inspections\/\">parapet inspections<\/a> are required annually for all buildings subject to FISP. Although parapet observation reports are not submitted to the DOB, they must be kept on file for at least six years and made available upon request. Failure to produce a report when asked can result in penalties ranging from $1,250 to $10,000.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Next Steps<\/strong><\/p>\n<p style=\"text-align: justify;\">With the 10th Cycle now underway, timing matters. If your building hasn\u2019t begun its FISP planning, or you're working through access challenges or 9th Cycle filings, there\u2019s still time, but getting started now is critical.
